We reserve the right to modify these terms at any time. Your continued use of our services following any changes constitutes acceptance of those changes.

2. Description of Services

Digipedia provides digital transformation solutions including but not limited to identity management, payment processing, communication platforms, and enterprise software services. The specific features and functionality available to you depend on your subscription plan and applicable agreements.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice.

3. User Accounts

To access certain features of our services, you may be required to create an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these terms or for any other reason at our sole discretion.

• All fees are non-refundable unless otherwise stated
• We may change our fees upon reasonable notice
• You are responsible for all applicable taxes

Failure to pay fees may result in suspension or termination of your access to our services.

7. Limitation of Liability

To the maximum extent permitted by law, Digipedia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of our services.

Our total liability for any claims arising from these terms or your use of our services shall not exceed the amount you paid to us in the twelve months preceding the claim.

8. Termination

Either party may terminate these terms at any time for any reason. Upon termination:

• Your right to use our services will immediately cease
• You must stop using and delete any of our materials
• Provisions that should survive termination will remain in effect

We may suspend or terminate your access immediately if you breach these terms or if required by law.

9. Governing Law

These terms shall be governed by and construed in accordance with the laws of Kenya, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved in the courts of Kenya.

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
